a.) The “Refer a Service Professional” program (referred to herein as the “Promotion”) begins on January 2007 and ends on December 31, 2010 (the “Promotion Period”). All “Qualifying Referrals” (as defined below) must occur on or before December 31, 2010. b.) Any qualifying person who submits all required and valid information referring a NJ service professional to Garden State Apartments shall be eligible to participate in the Promotion (referred to herein as the “Participants”). c.) A “Qualifying Referral” is defined as a Participant successfully submitting, via the Garden State Apartments website, contact information (Name, Company Name, Phone, and e-mail address) (a “Referral”), which is not a “Duplicate Account” (as defined below) of a home service professional personally known to them and the Referral subsequently pays Garden State Apartment's Enrollment Fee, where applicable, passes the applicable screening criteria and is approved for membership into the Garden State Apartments NJ Professional Network by Garden State Apartments within 60 calendar days of Garden State Apartments' receipt of the Referral. Garden State Apartments reserves the right, in its sole discretion, to approve or deny prospective members of its Service Professional Network. d.) For each Qualifying Referral the Participant will earn a gift certificate. e.) Each Participant will be limited to a maximum cumulative award under the Promotion of gift certificate values of one thousand two hundred and fifty dollars ($1,250.00 USD) (i.e. 25 approved Referrals) per month. f.) Gift Certificates will be issued within approximately 45 days of the date that the Qualifying Referral has been approved into the Garden State Apartments NJ Professional Network. These gift certificates will be delivered electronically directly from to the Participant’s specified e-mail address. g.) “Duplicate Accounts” are defined as NJ service professionals presently in Garden State Apartments' sales database, including prospective, current and former member service professionals. h.) All Referral contact information and e-mail addresses become property of Garden State Apartments, which reserves the right to market to such information or e-mail addresses in its sole discretion. i.) Garden State Apartments reserves the right, in its sole discretion, to cancel or suspend this Promotion at its sole discretion. In such event, notice of the termination of the Promotion shall be communicated to any Participant’s thereafter upon submission of a referral by a Participant. j.) Garden State Apartments is not responsible for any technical, hardware, software, or telephone failures of any kind, lost or unavailable connections, incomplete, garbled or delayed computer transmissions, whether caused by Garden State Apartments, users of the Garden State Apartments website or by any of the equipment or programming associated with or utilized in this Promotion or by any technical or human error which may occur in the processing of submissions, or fraud. k.) Employees and Consultants (and their immediate families) of Garden State Apartments or any subsidiary or affiliated company, are not eligible to participate in this Promotion. l.) Garden State Apartments reserves the right, in its sole discretion, to exclude or remove any Participant from the Promotion. m.) There is no cash or exchange value for any gift certificates awarded in conjunction with the Promotion. The certificates are not transferable or exchangeable, and may not be substituted or redeemed for cash. n.) Void where prohibited or restricted by law, statute, regulation or other appropriate authority. o.) Promotion is open to legal residents of the United States who are eighteen (18) years or older at the time of Referral submission. Proof of age, eligibility and identity must be furnished upon request. p.) Payment of all applicable federal, state and local taxes is the sole responsibility of the Participant recipient. q.) Garden State Apartments specifically disclaims, and assumes no responsibility or liability for damages, loss or injury resulting from redemption of any certificates or merchandise received upon redemption or exchange of a certificate. |
