There are many leases, forms, and contracts involved in renting a property. Below are some of the most commonly used types of forms, and links so that you can purchase your own!
Apartment Lease Agreement - This is a sample New Jersey residential real estate lease specially crafted for our members by the attorneys at the law firm of Levy, Ehrlich, & Petriello.
Truth in Renting - A guide to the rights and responsibilities of residential tenants and landlords in New Jersey.
NJ Tenant Security Deposit W-9 Form - This form is required by the IRS and banks in order for the landlord to deposit the tenants security deposit into an interest bearing account.
Lead Paint Pamhplet - This form must be included in any lease. The EPA has fined landlords up to $250,000 and broker's $12,000 for non-compliance.
NJ Apartment Condition Form - A great documentation tool is the Apartment Condition Form. You should have a blank one prepared for your tenant to fill out as soon as they move in, and have them send it in to you within a week of their move-in date. This way, any damanges not recorded by this initial form can be deducted from the tenants' security deposit.
Commercial Lease Agreement - Only a bulletproof-lease agreement that clearly specifies the expectations and terms – in effect, “gets it all in writing” – will prevent complications, misunderstandings, or even legal hot water.
Residential Rental Applications - With a standard, thorough rental application, you can obtain information from that prospective tenant, including prior rental history, employment and credit related information. A complete form should ask the would-be tenant to consent to a credit and background check. The information you gather through this application can tell you whether your prospective tenant is likely to be considerate and responsible, or whether he will be the proverbial tenant from hell.
Move-in and Move-out Inspection Checklist - Whenever a Tenant moves in or moves out of any rented/leased residential premises, the Landlord and the Tenant(s) should conduct a joint inspection of the premises. This will allow the parties to determine if any part of the premises were damaged before the start of occupancy or during the duration of the lease. A Premises Move-In / Move-Out Inspection Checklist form is useful to document the inspection and can help avoid problems at the end of the lease. A type of form and documentation can also help the Landlord justify any security deposit deductions, if warranted.
New Jersey Lease Termination Agreement - This agreement is simply a written record of their agreement to end the lease early. By entering into this type of agreement, the parties can avoid many future problems and misunderstanding surrounding the termination of the lease.
