The New Jersey Assembly Housing and Local Government Committee, Senate Bill No. 1294 requires that as of July 1, 2005 every dwelling unit located in a building with fewer than three dwelling units, upon its sale, lease or transfer, shall be equipped with with at least one portable fire extinguisher. This extinguisher should consist of an ABC type, rated no larger than 10 pounds, and mounted within 10 feet of the kitchen area.

The Department of Community Affairs will promulgate rules and regulations to further clarify certain aspects of the statute prior to enforcement. The fine for non-compliance starts at $100 and you may want to contact your insurance carrier about your liability for loss due to non-compliance of the statute. Click here to read the bill text.
